Planning permission is either achieved through ‘self-promotion’ by the landowner (where they fund the application process) or via an agreement with a third-party promotion partner. The Land & Development Team has the expertise to advise landowners throughout this process, from the inception stage of initial land identification through to the eventual sale to a developer.
The strategic land services we offer are as follows:
- Land identification - comprehensive analysis and review of strategic holdings to assess what land might be suitable for development
- Land assembly – advising joint landowners on collaboration agreements and other appropriate structures
- Advising on long term development agreements – these can include Option Agreements, Promotion Agreements, Hybrid Agreements or a Subject to Planning contract
- Marketing & negotiation - sourcing a third party development partner and securing best commercial terms that meet the client’s objectives. This will include the agreement and preparation of a comprehensive set of heads of terms
- Legal agreement - working with the selected solicitor throughout the contractual drafting process
- Monitoring – ensuring the development partner complies with relevant planning obligations and the terms of the contract
- Disposal - negotiation of the price under an Option Agreement or an open market sale under a Promotion Agreement and Hybrid Agreement
- Professional consultancy on existing and historic long-term agreements – analysis (and in certain instances, renegotiation) of agreements to ensure they are compatible with current planning and market conditions.
